These Terms govern your use of Pemsi — the iOS app and the backend service at pemsi.serenity.games. By installing or using Pemsi, you agree to these Terms. If you don't agree, please don't use the service.
1. Who you're agreeing with
Pemsi is operated by Andrii Kedrov, an individual developer based in Ukraine. We are referred to as "we", "us", or "Pemsi". You are referred to as "you" or "user".
2. Licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Pemsi app on devices you own or control, subject to these Terms and the Apple Licensed Application End User Licence Agreement ("Standard EULA"). Where these Terms and the Standard EULA differ, the more restrictive provision applies to the in-app experience.
3. Account & eligibility
You must be at least 13 years old to use Pemsi (16 in some EU jurisdictions where local law sets a higher minimum). You are responsible for keeping your sign-in credentials secure and for activity that happens under your account.
4. Pemsi Pro subscription
Pemsi Pro is a recurring subscription sold through the Apple App Store. Three tiers are available: pemsi.pro.weekly, pemsi.pro.monthly, and pemsi.pro.yearly. Pricing is set in App Store Connect and displayed in your local currency.
- Auto-renewal. Subscriptions auto-renew at the end of each period unless you cancel at least 24 hours before renewal. Manage and cancel under Settings → Apple ID → Subscriptions on your iOS device.
- Free trial, if offered, converts automatically to a paid subscription at the end of the trial unless cancelled before then.
- Refunds are handled by Apple under the App Store's refund policy. We can't issue App Store refunds directly.
- Server-granted Pro (manual admin grant) and guest Pro (auto-granted to guest accounts) follow the same feature set but aren't billed through Apple.
5. Medical disclaimer
Pemsi is not a medical device, does not provide medical advice, and does not diagnose, treat, cure, or prevent any disease. Cycle predictions and AI Coach replies are wellness suggestions based on the data you log; they are not a substitute for consultation with a qualified healthcare professional. If you are pregnant, trying to conceive, dealing with a possible medical condition, or experiencing red-flag symptoms (severe pain, unusually heavy bleeding, fainting, missed periods with possible pregnancy risk), please consult a clinician — not an app.
6. Acceptable use
You may not:
- Use Pemsi to harass, abuse, or harm anyone.
- Attempt to reverse-engineer, decompile, or otherwise extract source code from the app, except where the law permits.
- Use automated systems to scrape, probe, or overload the backend.
- Sell, sublicense, or share access to a paid account or its features.
- Send AI Coach prompts that request medical diagnoses, illegal content, or content that violates OpenAI's usage policies.
We may suspend or terminate accounts that violate these rules.
7. Your content
You keep all rights to the cycle data, symptoms, notes, and other content you log in Pemsi ("Your Content"). You grant us the limited rights necessary to operate the service for you — storing it on your device, encrypted-syncing it to our servers if you turn that on, sending the privacy-scoped AI Coach context to OpenAI to fulfil your requests. We do not use Your Content to train any model and we do not sell it.
8. Service availability & changes
We work to keep the service running, but we don't guarantee 100% uptime. We may add, change, or remove features at our discretion. For changes that materially reduce Pro features during your paid period, we'll notify you and offer a prorated refund where Apple's policy allows.
9. Termination
You may stop using Pemsi at any time and request account deletion via support@pemsi.serenity.games or the in-app option. We may terminate or suspend access if you breach these Terms or use the service in a way that risks legal exposure for us. On termination, the licence in §2 ends; sections that by their nature survive (privacy, disclaimers, liability) remain in force.
10. Disclaimers
The service is provided "as is" and "as available". To the maximum extent allowed by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that cycle predictions will be accurate, that AI Coach replies will be correct, or that the service will be uninterrupted or error-free.
11. Limitation of liability
To the maximum extent permitted by applicable law, Pemsi will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising out of or relating to the service will not exceed the amount you paid us for the subscription in the 12 months before the claim arose.
Nothing in these Terms limits liability that cannot be limited under applicable law (such as liability for death or personal injury caused by negligence, fraud, or for any other matter for which liability cannot lawfully be excluded).
12. Apple-specific terms
You and Apple acknowledge that these Terms are between you and Pemsi, not Apple, and that Apple is not responsible for the app or its content. Apple is, however, a third-party beneficiary of these Terms and can enforce them against you. The Standard EULA's provisions on permitted devices, maintenance, IP, and product claims apply alongside these Terms.
13. Governing law
These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws principles. The courts of Kyiv, Ukraine have non-exclusive jurisdiction. Nothing in this section deprives you of any consumer protection you would have under the mandatory laws of your country of residence.
14. Changes to these Terms
We may update these Terms. If we make material changes, we'll update the effective date and, where reasonable, notify you in the app on next launch. Continued use of Pemsi after the effective date means you accept the updated Terms.
